These Terms of Service ("Terms") govern your access to and use of the KIVASMM website and services (the "Service"), operated by BOTKIVA DIGITAL SERVICES LTD ("we", "us", "our"). By creating an account, adding funds or placing an order you agree to these Terms, our Privacy Policy and our Refund Policy.

1. Eligibility & Account

You must be at least 18 years old (or the age of majority in your jurisdiction). You are responsible for keeping your login credentials confidential and for all activity under your account. One account per person; multiple accounts used to abuse free offers will be terminated.

2. Digital Services

All products are intangible digital services delivered electronically to the channel or link you provide. No physical goods are shipped. Delivery usually starts automatically after the order is placed; estimated delivery times are indicative and not guaranteed.

3. Your Responsibilities

You are solely responsible for ensuring that the target you submit is correct, public and belongs to you or that you are authorised to use it, and that your use of the Service complies with applicable laws and the terms of any third-party platform. We are not affiliated with any third-party platform and are not responsible for actions taken by such platforms on your account.

4. Prices, Balance & Payments

Prices are shown in USD on each product before purchase. Funds added to your account balance are used only to purchase services on this website, are not a bank deposit, do not earn interest and cannot be withdrawn or transferred.

Because our products are digital services that are delivered and consumed immediately, We do NOT offer refunds, returns, exchanges or cancellations under ANY circumstances, including (without limitation) change of mind, incorrect target/link entered by the customer, account suspension by a third-party platform, drops, or dissatisfaction with results. Account balance top-ups are also non-refundable. By completing a purchase you expressly request immediate performance and acknowledge that you lose any statutory right of withdrawal to the extent permitted by law.

If an order cannot be started due to a technical fault on our side, we may, at our sole discretion, re-deliver the service or credit the unused amount to your account balance (not as a cash refund). See our Refund Policy.

6. Chargebacks

Initiating a chargeback or payment dispute for a delivered service is a breach of these Terms. We reserve the right to suspend the account and to provide order logs, delivery records, IP addresses and your acceptance of these Terms as evidence to the payment provider.

7. Prohibited Use

You may not use the Service for any unlawful, fraudulent, abusive or infringing purpose, attempt to gain unauthorised access to our systems, or resell the Service without written permission.

8. Termination

We may suspend or terminate accounts that violate these Terms. Remaining balance on accounts terminated for abuse or fraud is forfeited.

9. Disclaimer & Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid for the specific order giving rise to the claim.

10. Changes

We may update these Terms from time to time. Continued use after changes constitutes acceptance. Current version: 2026-10-30.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which BOTKIVA DIGITAL SERVICES LTD is registered.
